§ 1. General Provisions

1. These Terms of Service define the rules for using the Tarotelly website, available at Tarotelly.pl (hereinafter: “Service”).
2. The owner and administrator of the Service is Tarotelly (hereinafter: “Administrator”).
3. Using the Service means acceptance of these Terms of Service.
4. The Service provides electronic services consisting of providing content related to fortune-telling, horoscopes, and spiritual advice generated by artificial intelligence.

§ 2. Definitions

1. User – any natural person using the Service.
2. Account – individual User account in the Service, created after registration.
3. Services – all services provided by the Service, including AI fortune-telling, horoscopes, chat with AI witches.
4. Content – all information, texts, graphics, and other materials available in the Service.

§ 3. Registration and User Account

1. Access to the full functionality of the Service requires creating an Account.
2. Registration is free and voluntary.
3. During registration, the User is required to provide true information.
4. The User is responsible for maintaining the confidentiality of their Account password.
5. Sharing the Account with third parties is prohibited.

§ 4. Rules for Using the Service

1. The User agrees to use the Service in accordance with applicable law, good customs, and these Terms of Service.
2. It is prohibited to:
   • publish offensive, vulgar content or content that violates the rights of third parties,
   • take actions that may disrupt the functioning of the Service,
   • use the Service for illegal purposes,
   • copy, modify, or distribute Service content without the Administrator's consent.

§ 5. Paid Services

1. The Service offers both free and paid services.
2. Detailed information about prices and the scope of paid services is available in the “Pricing” section.
3. Payments are processed through the Stripe system.
4. After making payment, the User receives access to purchased services according to the selected package.
5. The Administrator is not responsible for payment errors resulting from payment system operations.

§ 6. Nature of Services

1. Services provided by the Service are for entertainment purposes and do not constitute professional psychological, medical, or financial advice.
2. Fortune-telling and horoscopes are generated by artificial intelligence and should not be treated as certain predictions of the future.
3. The User uses the Service's services at their own risk.
4. The Administrator is not responsible for decisions made by the User based on content available in the Service.

§ 7. Intellectual Property Rights

1. All content available in the Service, including texts, graphics, logos, is protected by copyright.
2. The copyright owner is the Administrator or entities that have granted licenses to use the content.
3. Copying, modifying, or distributing content without the Administrator's consent is prohibited.

§ 8. Personal Data Protection

1. The Administrator processes Users' personal data in accordance with the General Data Protection Regulation (GDPR).
2. Detailed information regarding the processing of personal data can be found in the Privacy Policy.
3. The User has the right to access, correct, and delete their data.

§ 9. Complaints

1. The User has the right to file a complaint regarding the functioning of the Service or services provided.
2. Complaints should be submitted electronically to the contact address provided in the Service.
3. The Administrator reviews complaints within 14 days of receipt.
4. The response to the complaint will be sent to the User's email address.

§ 10. Withdrawal from Contract

1. A User who is a consumer has the right to withdraw from the contract within 14 days of its conclusion without giving any reason.
2. The right of withdrawal does not apply to services whose performance began with the User's express consent before the withdrawal period expired.
3. The withdrawal statement should be sent electronically.

§ 11. Liability

1. The Administrator makes every effort to ensure that the Service operates continuously and without errors.
2. The Administrator is not liable for:
   • interruptions in access to the Service resulting from technical reasons,
   • damages resulting from the use or inability to use the Service,
   • content generated by AI, which is for entertainment purposes,
   • actions of third parties, including other Users.

§ 12. Changes to Terms of Service

1. The Administrator reserves the right to change the Terms of Service.
2. Users will be informed about changes to the Terms of Service through an announcement in the Service.
3. Changes take effect 14 days after the announcement date.
4. Using the Service after changes are introduced means acceptance of the new Terms of Service.

§ 13. Final Provisions

1. In matters not regulated by these Terms of Service, Polish law shall apply.
2. Any disputes arising from the use of the Service will be resolved by the court competent for the Administrator's registered office.
3. These Terms of Service enter into force on the date of publication in the Service.
